These Terms of Use ("Terms") govern your access to and use of americanpawspet.com (the "Site") and the purchase of any products from American Paws®, a brand of XKY INC ("we", "us", "our"). By using the Site or placing an order, you agree to these Terms.

Eligibility

You must be at least 18 years old to make a purchase. By placing an order, you represent that you are of legal age and have the capacity to enter into a binding agreement.

Account & Order Information

You agree to provide accurate and complete information when creating an account or placing an order. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.

We reserve the right to refuse or cancel any order for any reason (including suspected fraud, errors in pricing or product information, or stock unavailability). If we cancel an order after charging your payment method, we will issue a full refund.

Pricing & Payment

All prices are listed in US Dollars (USD). We reserve the right to change prices at any time before you complete your order. Sales tax is added where applicable.

Payment is processed at checkout. We accept major credit cards, Apple Pay, Google Pay, Shop Pay, and PayPal. Wholesale accounts may qualify for Net 30 terms after the second order — see our Wholesale page for details.

Shipping & Returns

Shipping terms are described in our Shipping Policy. Return terms are described in our Return Policy. Both are incorporated into these Terms by reference.

Product Information

We make every effort to display product photos, descriptions, ingredient lists, and weights accurately. Colors may vary slightly between monitors. Single-ingredient natural treats may vary in size, color, and texture from batch to batch — this is normal and does not indicate a defect.

Our treats are intended as supplemental treats only, not a complete diet. Always provide fresh water with treats and supervise your pet.

Intellectual Property

The Site and all content on it — including text, images, logos, product packaging designs, code, and trademarks — are the property of XKY INC or its licensors and protected by US and international copyright and trademark laws. You may not copy, reproduce, modify, distribute, or display any content from the Site without our prior written permission.

American Paws® is a registered trademark of XKY INC. The American Paws logo and related marks are also trademarks of XKY INC. All other trademarks are the property of their respective owners.

User Conduct

You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to the Site or its servers
  • Interfere with the operation of the Site or any other user's use of it
  • Use automated tools (bots, scrapers, crawlers) to access or harvest information from the Site without our consent
  • Submit false, misleading, or fraudulent information

Reviews & Submissions

If you submit reviews, comments, or other content to the Site, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in connection with our business. You represent that you own or have rights to any content you submit.

Disclaimers

The Site and all products are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties — express or implied — including warranties of merchantability, fitness for a particular purpose, and non-infringement.

While we work hard to maintain accurate information, we do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

To the maximum extent permitted by law, XKY INC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any products purchased. Our total liability to you for any claim related to these Terms or your purchase will not exceed the amount you paid for the product giving rise to the claim.

Indemnification

You agree to indemnify and hold XKY INC, its officers, employees, and agents harmless from any claim, demand, or expense (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site or our products.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.

Any dispute arising from these Terms or your use of the Site will first be addressed by good-faith negotiation. If unresolved within 30 days, the dispute will be submitted to binding individual arbitration in San Bernardino County, California, under the rules of the American Arbitration Association.

You waive any right to pursue claims on a class-action basis. If arbitration is not permitted for a particular claim, you and XKY INC agree that the courts of San Bernardino County, California will have exclusive jurisdiction.

Changes to These Terms

We may update these Terms at any time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after a change constitutes acceptance of the updated Terms.
